The International Criminal Court (ICC) announced on Thursday it had issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant, charging them with war crimes and crimes against humanity. The charges stem from allegations including the use of starvation as a method of warfare and intentionally targeting civilians.
ICC Decision Sparks Global Controversy
The ICC’s move marks a historic decision against sitting and former high-ranking Israeli officials. This comes after Israel submitted challenges to the court’s jurisdiction and the validity of the charges, all of which were rejected. The ICC maintained that it had the authority to investigate actions in Palestinian territories, which it considers under its jurisdiction based on Palestine’s 2015 accession to the Rome Statute.
Israeli Leadership Responds

Israeli President Isaac Herzog strongly condemned the ICC’s decision, calling it “outrageous” and accusing the court of undermining the principles of universal justice.
“Taken in bad faith, the outrageous decision at the ICC has turned universal justice into a universal laughingstock,” Herzog stated. “It makes a mockery of the sacrifice of all those who fight for justice – from the Allied victory over the Nazis till today.”
Herzog emphasized that the ICC’s focus on Israeli leaders fails to address critical context, including Hamas’ alleged war crimes. He cited the October 7, 2023, attacks, during which Hamas militants killed over 1,200 Israelis, injured thousands, and kidnapped numerous civilians and soldiers. Herzog also accused the ICC of disregarding Hamas’ reported use of civilians as human shields.
Charges Against Netanyahu and Gallant
The ICC accuses Netanyahu and Gallant of grave breaches of international law, citing incidents of:
- Targeting civilian populations during military operations in Gaza.
- Using starvation as a tactic in besieged areas.
The court also noted that the charges align with documented patterns of conduct during the ongoing conflict. The ICC stated that these charges reflect its mandate to hold individuals accountable for serious violations of humanitarian law.
A Divisive Moment
The ICC’s decision has drawn mixed reactions globally. Advocates for Palestinian rights have hailed the warrants as a step toward accountability for alleged Israeli war crimes. In contrast, Israeli officials and their allies argue the move reflects political bias and undermines the credibility of the court.
U.S. officials have expressed concerns about the ICC’s intervention in the Israeli-Palestinian conflict, warning it could complicate diplomatic efforts.
Next Steps
As Israel is not a party to the ICC, it does not recognize the court’s jurisdiction. Consequently, Netanyahu and Gallant are unlikely to face arrest unless they travel to countries that have ratified the Rome Statute, obligating them to enforce ICC warrants.
The court’s decision represents a significant development in international law, setting the stage for further debate over justice, accountability, and the political dimensions of the Israeli-Palestinian conflict.
