An Iowa District Court has reversed a $10 million verdict from 2007 against West Des Moines businessman Gary Kirke and his casino company, Wild Rose Entertainment LLC, saying they did not breach a contract with a consulting company.
One of the six attorneys representing Kirke in the case was Iowa First Lady Mari Culver, who practices law with the Des Moines firm Duncan, Green, Brown & Langeness.
A lower court awarded the $10 million judgment to John Pavone and Signature Management Group LLC. Pavone, a veteran executive in Iowa’s gambling industry, said he and his company had entered into a contract to manage the Wild Rose casino and hotel in Emmetsburg, which opened in 2006.
Wild Rose denied SMG’s argument, contending the parties did not intend to be bound to a the contract prior to signing a separate, formal written management agreement.
A three-judge panel agreed with Wild Rose overturned the earlier decision on Wednesday, saying the district court judged erred in overruling Wild Rose’s motions for directed verdict and in submitting the claims to the jury.
